Terms & Conditions:

Introduction

  • These terms and conditions constitute a legally binding agreement between the client ("Participant") and Kelly Keltos Photography ("Photographer").

  • By submitting and having your Photographs taken, the Participant agrees to be bound by these terms and conditions.

  1. Copyright and Licensing

    • All images and photographs taken by Kelly Keltos Photography are the exclusive property of the Photographer.

    • The copyright of all images remains with Kelly Keltos Photography.

    • The Photographer grants the Participant a non-exclusive, non-transferable license to use the images for personal, non-commercial use, including sharing on social media platforms.

    • Licensing rights are managed through Dropbox and cover the Participant's use on social media platforms only.

  2. Use of Images

    • Participants are prohibited from using the images in a defamatory, derogatory, or otherwise harmful manner.

    • Images may not be altered in any way without the prior written consent of the Photographer.

    • Participants are prohibited from reselling, redistributing, or using the images for commercial profit without obtaining a commercial license from the Photographer.

  3. Image Delivery

    • Images will be delivered digitally via Pixiset within 2 weeks after the photography session.

    • High-resolution images will be provided in a downloadable format.

  4. Model Release

    • The Participant grants the Photographer the right to use the images for promotional purposes, including but not limited to the Photographer's portfolio, website, and social media channels, unless otherwise agreed in writing.

  5. Limitation of Liability

    • The Photographer is not liable for any indirect, incidental, or consequential damages arising from the use of the images.

    • The Photographer's liability for any claim arising under this agreement shall be limited to the amount paid by the Participant for the services.

  6. Governing Law

    • These terms and conditions are governed by and construed in accordance with the laws of the State of California.

  7. Acceptance of Terms

    • By checking the terms & conditions section of the contact form participating in the headshot station from Kelly Keltos Photography, the Participant acknowledges that they have read, understood, and agreed to these terms and conditions.
